01 Parties
This site and the services described on it are operated by Abkerim Bekirov ("I", "me", "my"). Contact: hello@bybekirov.com.
"You" means the visitor of this site or the client who has engaged me for work. "Services" means any work described on bybekirov.com.
02 Acceptance
By browsing bybekirov.com, submitting the contact form, or engaging me for paid work, you confirm that:
- You are at least 18 years old.
- You have the authority to enter into agreements on behalf of yourself or your business.
- You have read and agree to these Terms and the Privacy Policy.
03 Engagements
Pricing and scope
The prices shown on bybekirov.com are starting ranges, not firm quotes. Every paid engagement begins with a written scope sent by email, stating the deliverables, timeline, and final price. The engagement begins once you confirm that scope in writing.
Payment on delivery
The standard model is payment on delivery:
- No deposit is required to start work.
- An invoice is issued when the deliverable matches the agreed scope.
- Payment is due within 7 calendar days of invoice issuance, unless otherwise agreed in writing.
For monthly recurring services, invoices are issued at the end of each month for completed work, with the same 7-day payment term.
Delivery
A deliverable is considered delivered when it materially matches the written scope. Cosmetic preferences, scope changes, or new requirements raised after sign-off are handled as revisions.
Revisions
Each fixed-scope project includes up to two rounds of revisions within the agreed scope, free of charge. Additional revisions or work outside the original scope are quoted and invoiced separately.
If not satisfied
If the delivered work does not materially match the written scope, it will be revised at no additional charge until it does, or the engagement may be mutually terminated with no further obligation for that deliverable.
04 Client responsibilities
You agree to:
- Provide accurate information and access required to perform the work.
- Respond to questions, drafts, and approval requests within a reasonable time. Delays on your side may extend the timeline.
- Hold the rights or permissions for any content you provide (text, images, logos, reviews). You confirm that nothing you submit infringes third-party rights.
- Not submit any health, medical, payment card, government ID, or other regulated sensitive data through this site or by email.
05 Late payment
Invoices unpaid past their due date may result in:
- A late fee of 1.5% per month on the outstanding balance, or the maximum permitted by law, whichever is lower.
- Suspension of ongoing work until the balance is cleared.
- Suspension of access to any hosted or managed services until the balance is cleared.
06 Cancellation
Project work
Either party may cancel a one-time project at any time before delivery by written notice. Under the payment-on-delivery model, you owe nothing for undelivered work, except any third-party costs already incurred at your request (such as paid licenses or stock assets).
Monthly work
Monthly engagements are month-to-month with no minimum term. Either party may cancel by giving written notice at least 7 days before the next billing cycle.
07 Ownership and intellectual property
Once an invoice is paid in full:
- Custom work produced for you (website code, copy, audit reports, design files) becomes your property.
- You may use it indefinitely without further payment.
The following remain my property:
- Pre-existing tools, templates, scripts, and methodologies developed before or outside your engagement.
- Aggregated, anonymized insights from the work.
- bybekirov.com itself, including all text, design, code, and graphics. You may not copy or republish any part of this site without written permission.
I may reference completed work as part of my portfolio unless you request in writing for the engagement to remain confidential.
08 Confidentiality
Non-public information shared during an engagement is treated as confidential and will not be disclosed to third parties except as needed to perform the work or as required by law. You agree to extend the same confidentiality to any non-public information shared with you.
09 No guarantees
Any performance figures shown on bybekirov.com are illustrative ranges and not promises or forecasts for your specific business. Outcomes depend on factors outside my control, including search engine algorithms, competitor activity, market size, and your own operations.
No specific rankings, lead volumes, traffic numbers, or revenue outcomes are guaranteed. What is guaranteed is that the delivered work will match the written scope and be performed competently.
I am not affiliated with, endorsed by, or controlled by Google, Microsoft, or any other platform mentioned on this site.
10 Disclaimers
I do not warrant that the site will be error-free, secure, or continuously available, and I am not responsible for downtime or data loss caused by third-party services.
11 Limitation of liability
12 Indemnification
You agree to indemnify and hold harmless Abkerim Bekirov from any third-party claims, damages, or expenses arising out of content you provide that infringes third-party rights, your violation of these Terms, or your misuse of any deliverable.
13 Termination
I may pause or terminate any engagement, with written notice, if you materially breach these Terms or any written scope, if continued performance would require violation of any law or platform policy, or if you behave abusively. You remain responsible for payment of any work already delivered.
14 Dispute resolution
Before initiating any formal proceeding, both parties agree to attempt to resolve the dispute by writing to hello@bybekirov.com describing the issue and a reasonable time (no less than 14 days) for response.
15 Acceptable use
When using bybekirov.com, you agree not to:
- Use the site to transmit spam, malware, or any harmful or illegal content.
- Attempt to access non-public areas, scrape the site at scale, or interfere with its operation.
- Reverse-engineer, copy, or redistribute the site's design, code, or content.
- Impersonate me or misrepresent your affiliation with me.
16 Communications
When you submit the contact form or engage me, you consent to receive related transactional communications by email. You can opt out of any non-essential communications at any time by replying or emailing hello@bybekirov.com.
17 Changes to these Terms
I may update these Terms over time. The "Last updated" date at the top reflects the most recent version. For active clients, material changes will be notified by email and will not apply retroactively to engagements already under way. For visitors, continued use of the site after changes means you accept the updated Terms.
18 Miscellaneous
- Severability. If any provision is held unenforceable, the remaining provisions stay in full effect.
- No waiver. Failure to enforce any right is not a waiver of that right.
- Assignment. You may not assign these Terms to a third party without written consent.
- Entire agreement. These Terms, together with the written scope of any paid engagement and the Privacy Policy, constitute the entire agreement between us.
